L’Oréal suing Drunk Elephant for patent infringement

L’Oréal USA Creative Inc. is suing Drunk Elephant for allegedly violating a patent filed by L’Oréal in 2005, which relates to L-Ascorbic acid – a form of vitamin C.

The lawsuit, filed on November 14, states that Drunk Elephant was aware of the patent, as L’Oréal reached out to them, but the brand continued to distribute the product anyway.

L’Oréal is requesting the judge grant damages from the alleged infringement, and for the court to ban Drunk Elephant from selling C-Firma.

Drunk Elephant, which was founded in 2012, is well-known for its clean skincare products. Its growth is said to be enormous – with a cult following that is driven by retailers such as Sephora, Cult Beauty and the sales from the brand’s own website.

Drunk Elephant founder, Tiffany Masterson declined to comment on the lawsuit.
